This website is operated by Essy’s, trading under the name Novora The Label. Throughout the website, the terms “we”, “us”, and “our” refer to Novora The Label. Novora The Label offers this website, including all information, tools, and services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

Scope: These Terms of Service apply to users located in the European Union, Australia, New Zealand, the United Kingdom, the United States, and Canada.

By visiting our website and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including any additional terms and policies referenced herein and/or available by hyperlink.

These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services. Where these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Article 1 – Definitions

In these Terms and Conditions, the following terms shall have the meanings set out below:

Cooling-off period: the period within which the consumer may exercise their right of withdrawal.

Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the trader.

Day: calendar day.

Durable data carrier: any medium that enables the consumer or trader to store information addressed personally to them in a way that allows future consultation and unaltered reproduction of the stored information.

Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period.

Trader: Essy’s, trading under the name Novora The Label, a sole proprietorship established in the Netherlands.

Distance contract: a contract concluded within a system organised by the trader for distance selling of products, whereby exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the contract.

Terms and Conditions: these Terms and Conditions of the trader.

Article 3 – Scope of Application

These Terms and Conditions apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer.

Before the distance contract is concluded, the text of these Terms and Conditions shall be made available electronically in such a way that the consumer can store them on a durable data carrier.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Article 4 – The Offer

The offer contains a complete and accurate description of the products offered. Obvious errors or mistakes in the offer are not binding on the trader.

Images are illustrative and slight variations in colour or appearance do not constitute non-conformity.

All prices are displayed in the currency indicated at checkout. Prices may exclude import duties, customs clearance charges, local VAT, GST or sales taxes for orders delivered outside the European Union unless explicitly stated otherwise.

For deliveries to Australia, New Zealand, the United Kingdom, the United States and Canada, additional customs charges may apply. These charges are the sole responsibility of the consumer.

Article 5 – The Contract

The contract is concluded at the moment the consumer accepts the offer and completes the checkout process.

The trader reserves the right to refuse or cancel orders in cases of suspected fraud, incorrect pricing, payment issues, or unavailability of stock.

Article 6 – Right of Withdrawal

For consumers residing within the European Union, a statutory withdrawal period of 14 days applies in accordance with EU consumer law.

The trader voluntarily offers a 30-day return period unless mandatory local consumer law provides otherwise.

For consumers residing outside the European Union, mandatory consumer protection laws of the country of residence may apply and cannot be excluded.

Returned products must be unused, in original condition, and in original packaging where reasonably possible.

Article 7 – Costs of Withdrawal

Return shipping costs are borne by the consumer unless the product is defective or does not conform to the contract.

The trader is not responsible for customs duties paid at import, customs delays, or return clearance charges.

Refunds will be issued within 14 days after receipt of the returned product or proof of return, using the original payment method.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products:

  • Made according to consumer specifications
  • Clearly personalised
  • Not suitable for return for hygiene reasons once unsealed
  • That deteriorate rapidly

Such exclusions apply only where legally permitted and clearly stated before purchase.

Article 9 – Delivery and Performance

Products may be shipped from international fulfilment partners located outside the European Union.

Delivery times are estimates and may vary due to customs inspections or carrier delays.

The trader is not liable for delays caused by customs authorities, force majeure events, international logistics disruptions, or incorrect address details provided by the consumer.

Risk of loss or damage transfers to the consumer upon delivery.

Article 10 – Conformity and Consumer Rights

The trader guarantees that products conform to the contract and meet reasonable standards of quality.

Nothing in these Terms excludes mandatory consumer rights under:

  • Australian Consumer Law
  • New Zealand Consumer Guarantees Act
  • United Kingdom Consumer Rights Act 2015
  • Applicable United States state consumer protection laws
  • Canadian federal or provincial consumer protection legislation

Where mandatory provisions apply, they shall prevail over conflicting clauses in these Terms.

Article 11 – Limitation of Liability

To the maximum extent permitted by law:

The trader’s total liability is limited to the purchase price of the product concerned.

The trader shall not be liable for indirect, incidental, consequential or punitive damages, including loss of profit or revenue.

Nothing in these Terms limits liability where such limitation is prohibited by mandatory law.

Article 12 – Complaints

Complaints must be submitted via  support@novorathelabel.com within a reasonable time after discovery of the issue.

The trader will respond within 14 days of receipt.

Consumers residing in the European Union may have access to alternative dispute resolution mechanisms as required by applicable law.

Article 13 – Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Netherlands.

If the consumer resides outside the Netherlands, mandatory provisions of the consumer’s country of residence may apply.

Disputes shall be submitted to the competent court in the Netherlands unless mandatory consumer law provides otherwise.
